PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY
Please read this Agreement carefully before signing. By signing this Agreement, you acknowledge that you understand its contents and that you are voluntarily giving up certain legal rights.
This Agreement is entered into by and between 570 JiuJitsu, LLC (“Academy”) and the undersigned participant, or if the participant is under eighteen (18) years of age, the participant’s parent or legal guardian.
1. Voluntary Participation
The participant voluntarily chooses to participate in Brazilian Jiu-Jitsu, wrestling, grappling, self-defense instruction, strength and conditioning, open mat sessions, competitions, seminars, demonstrations, and all related activities offered by the Academy (“Activities”).
2. Health Certification
The participant represents that they are physically capable of participating in the Activities and are not aware of any medical condition, illness, injury, or impairment that would make participation unsafe.
The participant agrees to immediately notify an instructor of any injury, illness, or medical condition that may affect safe participation.
3. Inspection of Facilities
The participant agrees to inspect the training area, mats, equipment, and facilities before participation. If any condition appears unsafe, participation will cease immediately until the concern has been reported to an instructor.
Parents and guardians agree to instruct minor participants to comply with this requirement.
4. Assumption of Inherent Risks
The participant understands that Brazilian Jiu-Jitsu and related martial arts are contact sports involving significant inherent risks that cannot be eliminated regardless of the level of care exercised.
These risks include, but are not limited to:
- Cuts, bruises, burns, and abrasions;
- Sprains, strains, dislocations, fractures, and torn ligaments or tendons;
- Neck, back, spinal, head, and joint injuries;
- Concussions and traumatic brain injuries;
- Loss of consciousness;
- Exposure to bacteria, viruses, fungi, and other communicable illnesses;
- Permanent disability;
- Death.
The participant further understands that injuries may result from contact with instructors, training partners, spectators, equipment, or the condition of the premises, and that not every risk can be anticipated.
The participant knowingly and voluntarily assumes all such risks.
5. Rules and Safety
The participant agrees to:
- Follow all instructions given by Academy staff;
- Use equipment only as intended;
- Refrain from reckless or dangerous conduct;
- Immediately report injuries or unsafe conditions;
- Stop participation whenever instructed by Academy staff.
Failure to comply with Academy rules may result in suspension or termination of participation.
6. Emergency Medical Care
If emergency medical treatment becomes necessary and the participant is unable to consent, the participant authorizes the Academy to seek emergency medical care.
The participant understands that the Academy does not provide medical services and is responsible for all medical expenses incurred.
7. Release and Waiver
The participant acknowledges the inherent risks of participation and voluntarily assumes those risks.
The participant further acknowledges that participation is voluntary and that no representation has been made guaranteeing the participant’s safety or freedom from injury.
8. Indemnification
The participant agrees to be responsible for their own actions during participation and agrees to reimburse the Academy for property damage caused intentionally or through reckless conduct by the participant.
If the participant is a minor, the parent or guardian accepts responsibility for supervising the minor’s participation and for obligations arising from the minor’s intentional or reckless conduct.
9. Personal Property
The Academy is not responsible for loss of, theft of, or damage to personal property brought onto the premises.
Participants are encouraged to secure valuables.
10. Photography and Video
The participant understands that photographs and video recordings may be taken during classes, seminars, competitions, and other Academy events.
The participant grants the Academy permission to use photographs and video recordings containing the participant’s likeness for legitimate business purposes, including advertising, promotional materials, social media, newsletters, and the Academy website, without compensation.
Parents or guardians grant the same permission for minor participants.
11. Communicable Illness
The participant understands that participation in close-contact sports increases the possibility of exposure to communicable illnesses.
The participant agrees not to attend classes while experiencing symptoms of a contagious illness or when advised by a healthcare provider to avoid participation.
12. Severability
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
13. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania.
14. Entire Agreement
This document constitutes the entire agreement between the participant and the Academy regarding participation in Academy Activities and supersedes prior oral or written understandings relating to the subject matter of this Agreement.
15. Electronic Signatures
The parties agree that electronic signatures and electronic acceptance of this Agreement shall have the same force and effect as original handwritten signatures, to the extent permitted by applicable law.
ACKNOWLEDGMENT
I acknowledge that I have carefully read this Agreement in its entirety.
I understand the nature of Brazilian Jiu-Jitsu and related Activities, understand that participation involves inherent risks, have had the opportunity to ask questions, and voluntarily choose to participate.
I understand that if the participant is under eighteen (18) years of age, this Agreement must also be signed by a parent or legal guardian.
